Welcome to Mt. Kenya Sunpeak Adventure. By booking a tour, using our website, or engaging our services, you agree to the following Terms of Service.

 

1. Bookings and Payments

 

  • All bookings are subject to availability.
  • A deposit may be required to confirm your reservation.
  • The remaining balance must be paid before the commencement of your tour unless otherwise agreed.
  • Prices are subject to change without prior notice until a booking is confirmed.
2. Cancellations and Refunds

 

  • Cancellation requests must be made in writing.
  • Refund eligibility depends on the timing of cancellation and any non-refundable expenses already incurred, including park fees, accommodation, and third-party bookings.
  • In the event of cancellations due to extreme weather, natural disasters, government restrictions, or other circumstances beyond our control, we will work with you to reschedule your tour where possible.
3. Health and Fitness

 

Participants are responsible for ensuring they are physically fit for the activities they book. Certain tours, including mountain trekking and climbing, require good physical condition. Please disclose any relevant medical conditions before your trip.

4. Assumption of Risk

 

Adventure travel involves inherent risks, including changing weather, wildlife encounters, altitude-related conditions, and rugged terrain. By participating, you acknowledge these risks and agree to follow the instructions of our guides at all times.

5. Travel Insurance

 

We strongly recommend that all guests obtain comprehensive travel insurance covering medical emergencies, trip cancellations, evacuation, and personal belongings.

6. Client Responsibilities

 

Guests are expected to:

  • Follow guide instructions.
  • Respect local communities and cultures.
  • Protect the environment.
  • Comply with park regulations and Kenyan laws.
7. Limitation of Liability

 

Mt. Kenya Sunpeak Adventure shall not be liable for delays, losses, injuries, or damages resulting from circumstances beyond our reasonable control, including weather, transportation delays, government actions, or force majeure events.

8. Changes to Itineraries

 

We reserve the right to modify itineraries where necessary to ensure guest safety or due to weather, road conditions, park regulations, or operational requirements.

9. Governing Law

 

These Terms shall be governed by the laws of the Republic of Kenya.
